Terms of Service

1. Acceptance of Terms

By accessing or using the Appzentic Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Account Registration

You must be at least 13 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at legal@appzentic.com if you suspect unauthorized use.

3. Permitted Use

You may use the Service to build, host, and publish apps for lawful purposes. You agree not to:

3.1 Prohibited App Content

  • Build apps that violate applicable laws, regulations, or third-party rights
  • Build apps that facilitate illegal activities, harassment, hate speech, or exploitation
  • Use the Service to generate, store, or distribute unlawful, obscene, or harmful content
  • Impersonate other users, organizations, or entities within apps you build
  • Resell or sublicense access to the Service or its AI capabilities without written permission

3.2 Prohibited System Abuse

You may not use the Service — including its AI tools, build environment, or any API — in any way that damages, disrupts, or exploits our infrastructure. Specifically, you agree not to:

  • Malicious AI instructions — issue prompts or instructions to AI tools with the intent to attack, probe, or compromise Appzentic's servers, databases, or internal systems
  • Resource abuse — deliberately consume excessive server resources, including but not limited to: uploading or downloading large volumes of files to saturate bandwidth or fill disk storage; running CPU-intensive processes unrelated to legitimate app builds
  • Malware & harmful programs — upload, download, store, or execute trojans, viruses, worms, ransomware, spyware, or any other malicious code via the Service
  • Cryptocurrency mining — install, run, or embed cryptocurrency mining software or scripts on Appzentic's infrastructure or within any app deployed on our platform
  • Unauthorized data access — attempt to access, extract, or exfiltrate other users' data, Appzentic's proprietary system information, configuration files, credentials, or internal APIs through any means
  • Denial of service — send automated, scripted, or volumetric requests designed to degrade or disrupt the availability of the Service for other users

These restrictions follow your app, not our hardware. They apply equally to an app you deploy to a server of your own through MyCloud, because the platform, the AI, and the build pipeline used to create and operate it are still ours.

3.3 Enforcement

Violations of Section 3.2 are taken seriously. Upon detection:

  • Minor violations — we may issue a warning, throttle your access, or suspend your account temporarily without prior notice
  • Severe violations — including deliberate infrastructure attacks, malware distribution, or large-scale resource theft — will result in immediate permanent account termination. We reserve the right to pursue civil and criminal legal action and to report violations to relevant law enforcement authorities

We actively monitor for anomalous resource usage and security incidents. If you believe you have identified a security vulnerability, please report it responsibly to security@appzentic.com rather than exploiting it.

4. Intellectual Property & Ownership

Your apps and code are yours. All source code, app builds (APK, IPA, AAB), and assets generated through your use of the Service are your property. You may export, use, modify, and publish them under your own accounts at any time.

Appzentic retains ownership of the platform itself — the AI Build Console interface, underlying infrastructure, and proprietary tools. These Terms do not transfer any Appzentic intellectual property to you.

5. Payment & Billing

Pay as you go. The Service is billed against a prepaid balance held in your account. There are no subscriptions and no recurring or automatic charges. Your balance is reduced by:

  • AI usage — each AI task run on Appzentic's own model access is charged according to the tokens it consumed, at the rates published at appzentic.com/pricing at the time the task runs. Tasks run on an API key or subscription of your own are not charged by Appzentic.
  • Hosting — apps running on Appzentic's shared servers are charged daily for the memory, outbound traffic and disk they used, at the published rates.

Building app packages and deploying apps are not charged in themselves; any AI work they trigger (for example, checking a deployment or repairing a failed build) is charged as AI usage. Charges are calculated from our metering records, and each one is visible in your account. If you believe a charge is wrong, contact legal@appzentic.com.

Starting a task, build or deploy requires a minimum balance, and daily usage limits may apply; both are shown on the pricing page. A task that has started is allowed to finish, which may take your balance below zero; any negative amount is deducted from credit you receive later.

Credit granted by Appzentic — at signup, for referrals, or as a promotion — has no cash value and cannot be transferred, exchanged or refunded. We may change our rates; changes are published on the pricing page and apply only to usage after they take effect. When paid top-ups are offered, the terms of purchase, including refunds, will be stated at the point of purchase.

If you run apps on infrastructure of your own through MyCloud, that infrastructure is billed to you by your cloud provider and not by Appzentic, and Appzentic does not charge hosting for it. See section 6.3.

6. Your Own Infrastructure (MyCloud)

MyCloud lets you run apps you build here on a server that belongs to you: either a machine you already operate, which you connect by installing our agent on it, or a machine we launch inside your own cloud account using credentials you provide. This section governs both.

6.1 Your Authority and Your Credentials

By supplying cloud credentials you represent that you are authorised to use that cloud account and to create resources in it. You are responsible for the permissions you grant: a credential capable of creating servers is generally capable of much more, and we recommend issuing a dedicated, least-privilege credential rather than an administrative one. You may revoke or delete a credential at any time, which ends our ability to act in that account.

If you would rather not share cloud credentials, attaching a server you already run requires none.

6.2 What We Will Do With Them

We use your credentials only to carry out actions you initiate: launching a server, preparing it to run your apps, connecting it to your account, obtaining and renewing an HTTPS certificate for a domain you nominate, writing the DNS records that make your apps reachable, and terminating the machine when you ask us to. We do not use them for any other purpose and do not share them with third parties.

6.3 Cost — Billed by Your Provider, Not by Us

A machine launched under MyCloud is created in your cloud account and billed directly to you by that provider, at their rates, from the moment it starts running until you terminate it. Appzentic does not resell, mark up, meter or collect these charges, and they are separate from any Appzentic subscription.

This includes a machine that keeps running because you forgot about it, stopped using Appzentic, or closed your Appzentic account. You are responsible for terminating resources you no longer want. We provide a termination control in your profile, but we cannot shut down a machine in your account once your credentials have been removed. We are not liable for cloud charges you incur, whether or not the resources were created through the Service.

6.4 Operation and Risk

The server is yours. You are responsible for what runs on it, for the data it holds, and for complying with your cloud provider's terms. We are not responsible for outages, data loss, security incidents, or provider actions affecting your machine, and we do not back up its contents. The Service's availability commitments and support cover our own platform, not infrastructure you own.

Where we launch a machine for you, we generate an SSH key pair for it and store the private key so you can download it. Anyone holding that key can access the server; keep it as you would any other credential.

6.5 If You Stop Using the Service

Terminating your Appzentic account does not terminate your server. The machine, its data, and the apps deployed on it remain in your cloud account and keep running. We will stop managing it and will delete our stored copies of your credentials and keys — which means you should download the SSH key before closing your account if you expect to need it.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, infrastructure failures, or events outside our control may cause downtime. We will provide reasonable notice for planned maintenance.

9. Termination

You may terminate your account at any time from account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

Upon termination, you will have 30 days to export your code and app builds, after which data will be deleted.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Appzentic Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

This exclusion expressly includes charges levied by a third-party cloud provider for resources created through MyCloud, and any loss of or damage to data held on infrastructure you own.

Our total liability for any claim shall not exceed the amount you paid Appzentic in the twelve months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or a service notice at least 14 days before they take effect. Continued use constitutes acceptance.
